FOR A RESIDENTIAL WIND TURBINE ORDINANCE

Whitman County proposes to add a new chapter to its zoning codes, Chapter 19.62 – Small Wind Energy Generators, along with related amendments to existing zoning chapters 19.03 – Definitions; 19.10 – Agricultural District; and 19.58 – Communications and Utility Facilities.

The proposed changes will guide how residential wind energy turbines can be built in all County zoning districts.

The current code allows for a residential wind turbine less than 40 feet in height to be built as a permitted use and those over 40 feet as a conditional use.

The proposed new code establishes more comprehensive standards for siting residential wind turbines that better address the safety, health and welfare of all residents in the County.

A public hearing on these amendments will be held by the Whitman County Planning Commission on Wednesday, August 26, 2009, in the Auditorium, first floor of the Whitman County Public Service Building, at 7:00 PM.

Interested persons may submit written comments regarding the proposed zoning action to the County Planning Office, P.O. Box 430, Colfax, WA 99111-0430, (fax) 509-397-6210, before 4:00 PM on Wednesday, August 26, 2009, or attend the hearing.

NOTICE OF PUBLIC HEARING

The Whitman County Commission will hold a public hearing on Monday, August 24, 2009, at 10:00 a.m. in the Whitman County Commission Chambers located in the Whitman County Courthouse at 400 North Main Street, Colfax, Washington, to take public comment on the following:

In 2009, Washington State enacted legislation designating seven demonstration projects to determine the feasibility of Local Revitalization Financing (LRF).

The Whitman County Pullman/Moscow Corridor improvement project was named one of these demonstration projects and approved for an improvement project award not to exceed two hundred thousand dollars per fiscal year for a maximum of twenty-five years.

This legislation allows Whitman County to take advantage of tax revenue generated by private investment in a revitalization area (RA) to help finance the cost of public infrastructure improvements, encouraging economic development and redevelopment of the RA. The boundaries of the proposed RA are described in the attached legal description (see Attachment A) and shown on the attached map (see Attachment B).

As a local government sponsor of a demonstration project, Whitman County must submit to the Washington State Department of Revenue, documentation that substantiates that the project has met the conditions, limitations, and requirements provided in the Second Substitute Senate Bill 5045.

On August 24, 2009, at 10:00 a.m.

the Commissioners will conduct a public hearing for the establishment of the Paradise Creek Revitalization Area (RA) in accordance with the LRF demonstration project requirements.

After conducting this hearing, the Commission anticipates taking action to adopt the proposed RA. The commission intends to issue bonds for an estimated $10 million as early as the fall of 2011.

If authorized, local revitalization financing is contemplated to commence as early as fall of 2011 and conclude no later than fall of 2036 to fund the repayment of bonds issued to finance eligible public improvements within the Paradise Creek RA. These improvements to the public infrastructure are described on the attached list of public improvements (see Attachment C).

The estimate of the public improvement costs to be borne by local revitalization financing is 5 million dollars. In addition to utilizing LRF, the other resources available to finance the improvements within the RA, include Public Facilities, Real Estate Excise Tax, Current Expense funds and private sector development contributions.

The public is invited to comment at the Whitman County Commissions’ hearing, or by submitting written comments or questions prior to the hearing to the Whitman County Commission, 400 N.
