NOTICE OF A PLANNING

COMMISSION PUBLIC HEARING

FOR A COMMERCIAL WIND

TURBINE ORDINANCE

Whitman County proposes to add a new chapter to its zoning codes, Chapter 19.61 – Commercial Wind Energy Facilities, along with related amendments to existing zoning chapters 19.03 – Definitions, 19.10 – Agricultural District, and 19.58 – Communications and Utility Facilities.

Related amendments will also be made to the Comprehensive Plan.

The proposed changes will guide how a commercial wind energy facility can be built in the County’s Agricultural District.

The current code allows for a wind energy facility to be placed in the Agricultural District with a conditional use permit.

That code, however, lacks sufficient criteria for such a development.

The proposed new code establishes comprehensive ecologically-based criteria for siting wind projects, and an applicant will be held to a high standard for protection of environmental health as well as public health, welfare and safety.

This new code proposal has similar elements in it for environmental and human protection that other counties in Washington have where operating wind farms exist.

A public hearing on these amendments will be held by the Whitman County Planning Commission on Wednesday, September 16, 2009, in the Auditorium, first floor of the Whitman County Public Service Building, at 7:00 PM.

Interested persons may submit written comments regarding the proposed zoning action to the County Planning Office, P.O. Box 430, Colfax, WA 99111-0430, (fax) 509-397-6210, before 4:00 PM on Wednesday, September 16, 2009, or attend the hearing. Copies of the proposed code can be obtained at the County Planning Office or on the County web page. There will be a charge for copies obtained at the Planning Office.

NOTICE IS HEREBY GIVEN that the Whitman County Commissioners will conduct a public hearing on Monday, September 21, 2009 at 10:45 a.m. in the their Chambers, Whitman County Courthouse, 400 N Main Street, Colfax, Washington. FINDING OF NO SIGNIFICANT IMPACT

It has been determined that this project will not constitute an action significantly affecting the quality of the human environment and accordingly the above-named TOWN OF GARFIELD, Whitman County, has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190).

The reasons for such decision not to prepare such statement are as follows: The project consists of replacing an existing 4" steel leaded joint pipe which leaks, with a new 8" service main. This project has no findings of significant impact on the quality of the human environment, priority habitat or species, wetlands, surface water or buffers as such. It will, in turn, provide some potential beneficial impact with reduced energy consumption (well pumping), eliminate environmental risk of leaded-jointed pipes, eliminate environmental waste of 1 mil gal annual water leakage, and improve fire flows.

An Environmental Review Record for this project has been made by the TOWN OF GARFIELD, which documents the environmental review of the project and more fully sets forth the reasons why such statement is not required.

This Environmental Review Record is on file at the above address and is available for public examination and copying upon request at Town Hall between the hours of 9:00 am and 5:00 PM, M-F, 2nd and 4th Wed. from Noon to 7:00 PM.

No further environmental review of such project is proposed to be conducted prior to the request for release of federal funds.

PUBLIC COMMENTS ON FINDING OF NO SIGNIFICANT IMPACT

All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the TOWN OF GARFIELD to the (office of the undersigned) (other specified place). All comments must clearly specify which decision they object to — the Finding of No Significant Impact. Such written comments should be received at PO Box 218, Garfield, WA 99131-0218 on or before September 25, 2009. All such comments so received will be considered and the TOWN OF GARFIELD will not request the release of federal funds or take any administrative action on the project on/or before the date specified in the preceding sentence.

TOWN OF GARFIELD

WATER LINE REPLACEMENT

IN FLOODPLAIN — NO PRACTICABLE ALTERNATIVE

The Town of Garfield will be replacing a 4" water main with an 8" water main on 2nd St from California to Parker St.(T18N R45EWM, Sec 33).

A small portion of the project, approx.

150 ft lies within the 100-yr floodplain (A4) and approx.

180 ft lies within the 100 to 500 yr floodplain (B).

This project must be located within the floodplain because no practicable alternatives exists outside the floodplain to serve the existing water customers.

This is a replacement of a water line underground and not subject to flooding.

There are no adverse impacts.

Mitigation measures to be taken to restore and preserve natural and beneficial values include a design that minimizes the amount of work in the floodplain.

Mitigation measures will be after the pipe is installed, roadway surface will be restored to original condition.
