NOTICE FOR APPLICATION FOR JUDGMENT FORECLOSURE
YOU AND EACH OF YOU, all other persons or parties unknown claiming any right, title estate, lien or interest in or to the real property described in this complaint and summons of foreclosure of tax liens are hereby notified that Whitman County, a duly organized and existing county of the State of Washington, is the owner and holder of the Amended Certificate of Delinquency No. G-2006 dated the 8th day of September, 2009; that the Certificate was issued to Whitman County on that date by the Treasurer of Whitman County, pursuant to laws, for real property taxes and interest due, unpaid and delinquent for three or more years for which no Certificate of Delinquency had previously been issued, that the descriptions of the parcels of real property included and described in said Amended Certificate of Delinquency, the names of the several owners as appear on the rolls of the Whitman County Treasurer, the amounts of 2006 and prior delinquent taxes on each of said parcels of said real property, including interest thereon at 12 percent per annum, as well as penalty and costs on the balance of unpaid taxes, computed on the 2nd day of September, 2009.
The years for which the same are due and unpaid as they appear and are set forth and described in said Amended Certificate of Delinquency.
The Amended Certificate of Delinquency follows hereafter.
YOU ARE FURTHER NOTIFIED that the plaintiff, Whitman County will apply to the Superior Court of the State of Washington, in and for the County of Whitman, for judgment foreclosing its lien for taxes against the parcels of real property in this complaint and summons hereinafter described, and you and each of you, are summoned to appear in the above-mentioned Court within thirty (30) days after service of this notice/complaint and summons, and defend this action or pay the amount due, plus allowable costs (e.g., title search and advertising), and in case of your failure to do so, judgment will be rendered in this action foreclosing the lien of such taxes and interest against the amounts shown to be due against the parcels, as described in the Amended Certificate of Delinquency No. G-2006, filed herein, plus allowable costs ( e.g.
title search and advertising).
You may redeem your property by payment of all delinquent taxes, interest, penalty and costs; however there is no right of redemption after the close of business on the day before the sale date, scheduled for December 11, 2009, according to RCW 84.64.070.

The personal representative named below has been appointed as personal representative or executor of this estate.
Any person having a claim against the decedent must, before the time the claim would be barred by any otherwise applicable statute of limitations, present the claim in the manner as provided in RCW 11.40.070 by serving on or mailing to the personal representative or the personal representative’s attorney at the address stated below a copy of the claim and filing the original of the claim with the court. The claim must be presented within the later of: (1) Thirty days after the Personal Representative served or mailed the notice to the creditor as provided under RCW 11.40.020(3); or (2) four months after the date of first publication of the notice.
If the claim is not presented within this time frame, the claim is forever barred, except as otherwise provided in RCW 11.40.051 and 11.40.060.
This bar is effective as to claims against both the decedent’s probate and nonprobate assets.

I. On September 25, 2009, at 10:00 a.m.
inside the main lobby of the Whitman County Courthouse, North 404 Main Street in the City of Colfax, State of Washington, the Trustee (subject to any conditions imposed by the Trustee) will sell at public auction to the highest and best bidder, payable at time of sale, the following described real property "Property", situated in the County(ies) of Whitman, State of Washington: Lot 3, Block 1, Roberts Addition to Oakesdale, according to plat thereof, recorded in Book C of plats, page 13, records of Whitman County, Washington.
Commonly known as: North 303 Roberts Street Oakesdale, WA 99158 which is subject to that certain Deed of Trust dated 09/18/06 and recorded on 09/28/06, under Auditor’s File No. 674477, records of Whitman County, Washington, from David J. Knerr and Donna J. Knerr, husband and wife, as Grantor, to Katrina E. Glogowski, OSB#03538, Mcarthy & Holthus, LLP, as Trustee, to secure an obligation "Obligation" in favor of Mortgage Electronic Registration Systems, Inc. solely as nominee for Fieldston Mortgage Company, as Beneficiary, the beneficial interest in which was assigned by Mortgage Electronic Registration Systems, Inc. to HSBC Bank USA, National Association, as Indenture Trustee of the Fieldstone Mortgage Investment Trust, Series 2006-3, under an Assignment/Successive Assignments recorded under Auditor’s File No. 683439.

II. No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the Obligation in any Court by reason of the Grantor’s or Borrower’s default on the Obligation.
III. The Beneficiary alleges default of the Deed of Trust for failure to pay the following amounts now in arrears and/or other defaults: Amount due to reinstate by 08/10/2009 Monthly Payments $17,813.52 Late Charges $730.73 Total Arrearage $18,544.25 Trustee’s Expenses (Itemization) Trustee’s Fee $472.50 Sale Costs $800.00 Total Costs $1,272.50 Total Amount Due: $19,816.75 Other known defaults are as follows: IV. The sum owing on the Obligation is: Principal Balance of $169,681.83, together with interest as provided in the note or other instrument evidencing the Obligation from 08/01/08, and such other costs and fees as are due under the Obligation, and as are provided by statute.
V. The Property will be sold to satisfy the expense of sale and the Obligation as provided by statute.
The sale will be made without representation or warranty, express or implied regarding title, possession, encumbrances or condition of the Property on September 25, 2009.
The default(s) referred to in paragraph III, together with any subsequent payments, late charges, advances costs and fees thereafter due, must be cured by 09/14/09 (11 days before the sale date), to cause a discontinuance of the sale.
The sale will be discontinued and terminated if at any time before the close of the Trustee’s business on 09/14/09 (11 days before the sale date), the default(s) as set forth in paragraph III, together with any subsequent payments, late charges, advances, costs and fees thereafter due, is/are cured and the Trustee’s fees and costs are paid.
The sale may be terminated any time after 09/14/09 (11 days before the sale date), and before the sale by the Borrower, Grantor, any Guarantor or the holder of any recorded junior lien or encumbrance paying the entire balance of principal and interest secured by the Deed of Trust, plus costs, fees, and advances, if any made pursuant to the terms of the obligation and/or Deed of Trust.

VII. The Trustee whose name and address are set forth below will provide in writing to anyone requesting it a statement of all foreclosure costs and trustee’s fees due at any time prior to the sale.
VIII. The effect of the sale will be to deprive the Grantor, and all those who hold by, through or under the Grantor, of all their right, title and interest in the Property.
IX. Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130.
Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee’s sale.
X. NOTICE TO OCCUPANTS OR TENANTS - The purchaser at the Trustee’s Sale is entitled to possession of the property on the 20th day following the sale, as against the Grantor under the Deed of Trust (the owner) and anyone having an interest junior to the deed of trust, including occupants who are not tenants.
After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under Chapter 59.12 RCW. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060.
