A counter claim for damages in excess of $25,000 was included in the response filed last week by the town of Rosalia to the Josh Bryan motorcycle rally suit. The town’s response, filed by Spokane Attorney Daniel Stowe, alleged Bryan failed to perform the duties and obligations called for in a licensing agreement he made with the town.
Among the failures, the response said Bryan didn’t conduct a rally in the town for the last two years and conducted the rally at another location.
A response was also filed by Ritzville attorney LR. Rusty McGuire on behalf of the other defendants, Rosalia Chamber of Commerce and Tina Coe, one of the individuals named.
That response alleges Bryan’s charges are “frivolous and asserted for vexatious purpose.”
Unlike the town’s response, the chamber response did not include a counter claim, but reserved the right to do so.
Among other points and denials listed in the answers, both responses contended the Bryans have failed to state a claim upon which relief can be granted.
