NOTICE OF ADDENDUM TO THE Whitman County SEPA FOR A COMMERCIAL WIND ORDINANCE
The Whitman County Planning Office issued an addendum to the original Determination of Non-Significance (DNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:
The creation of Whitman County zoning ordinance Chapter 19.61 — Commercial Wind Energy Facilities. The Whitman County Board of County Commissioners passed the ordinance to which the earlier DNS applied, on November 16, 2009. The ordinance that was passed differs from the proposed ordinance, to which the earlier DNS applied. The relevant differences for this addendum are that some of the minimum setbacks established in the ordinance that was passed were reduced from those in the proposed ordinance.
The Planning Office has determined this proposal will not have a probable significant adverse impact on the environment.

NOTICE OF PUBLIC HEARING
The Whitman County Commissioners will conduct a public hearing on December 7, 2009 at 11:30 a.m.
in their Chambers, Whitman County Courthouse, Colfax, Washington.
The purpose of the hearing is to review community development and housing needs, inform citizens of the availability of funds and eligible uses of the state Community Development Block Grant (CDBG), and to receive comments on proposed activities, particularly from low and moderate income persons and persons residing in the Whitman County area.
$125,968.00 will be available to Whitman County and Community Action Center to fund public service activities to low and moderate income persons in Whitman County.
These programs include: education, employment, money management, housing energy assistance, nutrition, linkages, self-sufficiency and health.
The proposed public service activities will be available for review at the Community Action Center, 350 SE Fairmont Road, Pullman, Washington on Monday, November 30, 2009 beginning at 9:00 a.m. or by calling 509-334-9147. If you are unable to be present at the hearing, you may submit your comments to the Whitman County Commissioners, 400 N Main Street, Colfax, WA 99111 no later than Friday, December 4, 2009. Comments on the Whitman County and Community Action Center’s past performance and use of the 2009 CDBG Public Service Grant award will also be received at this hearing.

Submittal Requirements:
The Town of Lamont is requesting Statement of Qualifications from consulting firms to provide the Town with a roster for engineering and architectural services with respect to projects planned for the 2010 calendar year. The Town published this request in accordance with the requirements of RCW 39.80. Individuals or firms wishing to be considered for projects should submit a SOQ showing their experience in planning, design and construction, and contract administration of water systems, street projects, architecture and municipal buildings, on-call consulting, and grant applications.
Projects may be funded through Public Works Trust Fund, Drinking Water State Revolving Fund, USDA-Rural Development, Transportation Improvement Board, and Washington State Community Development Block Grant Program with federal funds provided by the U.S. Department of Housing and Urban Development.
SOQ should address the firm’s experience in each of the categories listed. Interested consulting firms should submit references and resumes of proposed staff to be assigned to these projects. SOQ’s shall be limited to 15 pages, excluding resumes. Five (5) copies of the SOQ are due in the office of the Town by 5:00pm on December 17, 2009.
The Town may elect to interview any or all or select one or more firms from the submittals received. The Town reserves the right to advertise and retain other consultants on individual projects independent of the firm selected for this solicitation.

MITIGATED DETERMINATION OF NONSIGNIFICANCE
The Port of Whitman County issued a Mitigated Determination of Nonsignificance (MDNS) under the State Policy Act Rules (Chapter 197-11 WAC) for the following project:
Port of Almota 5-Pile Steel Moorage Dolphin Replacement Project. Project removes damaged dolphin and replaces it with an identical new dolphin.
Description of Proposal: The proposed project is located in the Snake River offshore of the Port of Almota, Government Lots 2 & 3, Section 13, Township 14 N, Range 42 E.W.M., zoned agricultural.
After review of a completed environmental checklist, the Port of Whitman County has determined this proposal will not have a probable significant adverse impact on the environment.
The following conditions are hereby incorporated, with the applicant’s agreement, into this Mitigated DNS: In order to minimize possible construction impacts on water quality and fish the applicant will:
* Conduct in-water work only during the approved in-water work window (December 1 to March 31), when juvenile salmonids are unlikely to be present.
* Use a vibratory hammer to drive all pile in the Snake River. Short duration impact hammer use to be mitigated by use of a bubble curtain.
* Be responsible for the preparation of a Spill Prevention Containment and Countermeasure Plan (SPCC) to be used for the duration of the project. The SPCC shall be submitted to the project manager at the Almota grain elevator before any construction activities begin. A copy of the SPCC with any project-related updates will be maintained at the work site by the contractor.
* The SPCC shall identify construction planning elements and recognize potential spill sources at the site. The SPCC shall outline responsive actions in the event of a spill or release and shall identify notification, reporting procedures, personnel responsibilities, site security, site inspections, and spill-prevention training.
* The SPCC will outline what measures the contractor will take to prevent the release or spread of hazardous materials, either found on-site or encountered during construction but not identified in contract documents, or any hazardous materials that the contractor stores, uses, or generates on the construction site during construction activities. These items include, but are not limited to, gasoline, oils, and chemicals. Hazardous materials are defined in RCW 70.105.010 under "hazardous substance."
* Maintain, at job site, the applicable equipment and material designated in the SPCC.
* Check equipment daily, before starting work, for leaks, and any necessary repairs shall be completed before beginning work.
* Retrieve any floating debris generated during construction using a skiff and a net. Debris will be disposed of upland.
* Because of the use of the impact hammer, the contractor will use an unconfined bubble curtain during pile installation.
* Excess or waste materials will not be disposed of in the Snake River.

The sum owing on the Obligation is: Principal Balance of $52,874.81, together with interest as provided in the note or other instrument evidencing the Obligation from 03/01/09, and such other costs and fees as are due under the Obligation, and as are provided by statute.
V. The Property will be sold to satisfy the expense of sale and the Obligation as provided by statute.
The sale will be made without representation or warranty, express or implied regarding title, possession, encumbrances or condition of the Property on December 4, 2009.
The default(s) referred to in paragraph III, together with any subsequent payments, late charges, advances costs and fees thereafter due, must be cured by 11/23/09 (11 days before the sale date), to cause a discontinuance of the sale.

VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their right, title and interest in the Property.
IX. Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130.
Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee’s sale.
X. NOTICE TO OCCUPANTS OR TENANTS - The purchaser at the Trustee’s Sale is entitled to possession of the property on the 20th day following the sale, as against the Grantor under the Deed of Trust (the owner) and anyone having an interest junior to the deed of trust, including occupants who are not tenants.
After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under Chapter 59.12 RCW. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060.
