NOTICE OF PUBLIC HEARING FOR A VARIANCE

The public is notified of a hearing for Keith Kopf before the Board of Adjustment on Thursday, December 2, 2010 at 7:00 p.m. in the Public Service Building, 1st floor auditorium, N. 310 Main Street, Colfax, Washington.

The applicant is requesting a variance from the North Pullman-Moscow Corridor District Setback code Section 19.15.070 Front Setbacks: the SR 270 setback shall be 35 feet from the north right-of-way line.

The site is located at 6952 SR 270 in Section 1, Township 14N., Range 45E., W.M. Whitman County, Washington. The applicant proposes to build a shop within 19 feet of the property line.

NOTICE OF SEPA DETERMINATION OF NONSIGNIFICANCE (DNS)

Whitman County Planning issued a Determination of Nonsignificance (DNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

AT&T Mobility proposes a new 123’ communication tower and a 12 x 20 foot equipment shelter. The proposed site is located on Kamiak Butte on private property with four other communications towers with access from Marvin Wells Road.

The Whitman County Planning Office issued a SEPA Determination of Nonsignificance (DNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) on November 18, 2010 for this project in Section 20, Township 16 N., Range 45 E., W.M., Whitman County, Washington.

NOTICE OF DRAFT ENVIRONMENTAL IMPACT STATEMENT (EIS)

Applicant: Palouse Wind, LLC. Attn: Benjamin Fairbanks, 1001 SW 5th Ave., Suite 1100, Portland, OR 97204 and Irina Makarow, 1001 SW 5th Ave., Suite 1100, Portland, OR 97204

Location: The Proposed Action is located in Whitman County in southeastern Washington, approximately 3 miles west of Oakesdale. The Proposed Action would be developed on approximately 5,000 acres of leased privately owned Agricultural District zoned land, nearly all of which is actively farmed and in wheat production.

Proposal: Notice of Availability – A Draft Environmental Impact Statement (DEIS) is issued for the Palouse Wind Project. The Applicant proposes to construct and operate up to 50 wind turbines that would generate approximately 100 megawatts (MW) of wind power in Whitman County. The Proposed Action would occupy approximately 5,000 acres. The Applicant has requested a conditional use permit from Whitman County. NOTICE OF HEARING

NOTICE IS HEREBY GIVEN that the Board of Whitman County Commissioners has completed and will place on file at the Office of the Whitman County Commissioners, Whitman County Courthouse, the Preliminary Budget for Fiscal Year 2011. The total amount of the budget for 2011 is approximately $55,000,000. The budget will be available November 29, 2010 and may be reviewed by any citizen who contacts the Clerk of the Board in the Commissioners’ Office or by calling 397-5240.

NOTICE IS FURTHER GIVEN that a public hearing for the purpose of adopting the budget for fiscal year 2011 will be held on Monday, December 6, 2010 at 6:00 p.m. and continued to Monday, December 20, 2010 at 10:30 a.m. in the Commissioners’ Chambers located in the Whitman County Courthouse at Colfax, Washington. Any taxpayer may appear and be heard for or against any part of the budget.

FINDING OF NO SIGNIFICANT IMPACT

It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above-named City has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190).

An Environmental Review Record for this project has been made by the above-named City, which documents the environmental review of the project and more fully sets forth the reasons why such statement is not required.

This Environmental Review Record is on file at the above address and is available for public examination and copying upon request at City Hall between the hours of 10 AM and 4 PM.

No further environmental review of such project is proposed to be conducted prior to the request for release of federal funds.

PUBLIC COMMENTS ON FINDING OF NO SIGNIFICANT IMPACT

All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the City to the office of the undersigned. All comments must clearly specify which decision they object to – the Finding of No Significant Impact or the Request for Release of Funds. Such written comments should be received at Tekoa City Hall on or before 11/26/2010. All such comments so received will be considered and the City will not request the release of federal funds or take any administrative action on the project on/or before the date specified in the preceding sentence.

RELEASE OF GRANT FUNDS

The City of Tekoa will undertake the project described above with Community Development Block Grant (CDBG) funds from the Washington State Department of Community, Trade and Economic Development (CTED) under Title I of the Housing and Community Development Act of 1974, as amended.

The City of Tekoa is certifying to CTED that John Jaeger, in his official capacity as Mayor consent to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making and action, and that these responsibilities have been satisfied.

The legal effect of the certification is that upon its approval the City of Tekoa may use the CDBG funds and CTED will have satisfied its responsibilities under the National Environmental Policy Act of 1969 and other environmental responsibilities listed in 24 CFR Part 58.

CTED will accept an objection to its approval only if it is on one of the following bases: a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by CTED; or b) that applicant’s environmental review record for the project indicates omission of a required decision finding or step applicable to the project in the environmental review process.

Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to CTED/CDBG Program Staff at 906 Columbia Street SW, PO Box 48350, Olympia, Washington 98504-8350.

Objections to the release of funds on bases other than those stated above will not be considered by CTED. No objection received after 12/11/2010 will be considered by CTED.
