Five charges have been filed against Nathanial Birch Simon II, 54, Albion resident who was arrested last Tuesday, March 29, after his girlfriend reported she had been assaulted and held against her will in the couple’s home.
Chief Deputy Prosecutor Bill Druffel Friday charged Simon with one count of first-degree assault, two counts of second degree assault, one count of unlawful imprisonment and one count of harassment.
Simon remains in jail under $500,00 bond which was set for pre-trial release by the court last Wednesday, March 30.
The first degree assault charge alleges Simon attacked his girlfriend, Debra Lowry, with a weapon. Lowry told deputies Simon carved the words “Do Not Resuscitate” in her chest.
The imprisonment charge alleges she was held at the Albion residence against her will between March 25 and 28. One of the second-degree charges alleges Simon strangled Lowry who reportedly was unconscious for part of the time.
Lowry last Tuesday was able to depart the residence where the couple lived and contacted officers from a girlfriend’s house in Albion, according to the police report.
Deputies March 29 conducted a warrant search of the residence and seized several items which they said could be potential evidence, the report said.
A domestic violence no contact order was also issued by the court March 31. Simon was ordered to not come within 1,000 feet of the alleged victim’s residence or workplace in the event he is released from jail under bond.
