Portion of Rosalia motorcycle suit dismissed

An order of dismissal was issued in superior court May 6 after some of the defendants in the Rosalia Motorcycle Rally suit reached an agreement with Joshua and Valerie Bryan. The settlement did not include the Town of Rosalia, Rosalia Chamber of Commerce and the Rosalia Parks & Recreation Dept., also listed as defendants in the suit.

Bryan filed the suit in April of 2009 after his agreement to produce the “100 Years of Motorcycles” rally was cancelled after the 2007 edition of the rally. The August rallies, which were founded by Bryan, brought large crowds of enthusiasts and spectators to Rosalia for three years.

Bryan’s suit alleged violations of contract, conspiracy and trademark infringements. Included in the settlement were the Rosalia Motorcycle Association which staged the rally in 2008 and Studebaker Manufacturing, Inc. Bryan contended the company, operated by Kelley and Roberta Messenger, infringed on copyrights for the “100 Years” title he had placed on the event and developed.

Bryan moved his rally to the Spokane Interstate Fairground after the Rosalia arrangement was severed.

Also in the settlement were Brodey Babb and Christina Babb, Tina Coe and Clint Coe, Terry Wade and Melissa Wilson, Chris Ferrell, Glenn Stites and Bonnie Stites and the Messengers.

The settlement was negotiated by five attorneys representing the Bryans and the different defendants. A segment in the petition for dismissal noted the settlement was not related to the Bryans’ suit against the town, chamber or park district.

The Bryans and their company, Next Level Equity, Inc., filed the suit in April of 2009.

After the court action started, Rosalia officials curtailed plans for the 2009 rally because use of the street and other facilities had become an issue in court.
