Michael Schaub was allowed release from jail after the court determined Friday morning it lacked evidence to keep him in custody. Schaub told the court he had falsely admitted taking methamphetamine because he had made a pledge with his wife to follow her to prison.
Schaub had been jailed after the state reported he was suspected of violating terms of supervision under a drug offender sentencing option.
A state probation officer reported Schaub after he discovered Schaub was not residing at the LaCrosse residence where he had registered for supervision. Schaub’s wife, Pamela Rogers, who was also arrested, last Friday was sentenced to two years in prison after the court determined urine tests showed she had reverted to using methamphetamine.
Schaub at that time told the court he had also been using meth, but the results of Schaub’s tests showed he was clean.
Schaub Friday morning told the court he had wanted to go to prison. He told the judge he and his wife had made a mutual pledge that if one of them was sent to prison the other would also go to prison.
Judge David Frazier set another review date in two weeks after results of another urinalysis are available to the court. If results of that test are clean, Schaub will be allowed to continued release under the drug offender program.
