MOTIONS DENIED IN ASSENBERG CASE

Motions by Michael Assenberg, Colfax, and Steve Martonick, his court-appointed defense attorney, were denied in superior court Friday. Assenberg told the court he was scheduled for a meeting this week with a Spokane Valley attorney about representing him in a civil case. He said the same attorney could handle the defense in the criminal charges filed against him after drug agents raided his Colfax home last May and confiscated marijuana plants.

Friday Assenberg listed what he said were points he wanted his defense attorney to bring up in his defense which involves state medical marijuana provisions.

Martonick has filed a motion to be dismissed as Assenberg’s court-appointed attorney, but Assenberg started Friday’s hearing by stating he had not received a copy of the motion.

Judge David Frazier Friday declined to rule for either side. He noted the dispute would resolve itself if Assenberg hired his own attorney and a notice of change of attorney was filed with the court.
