A motion to reconsider that was filed by attorneys for the town of Rosalia and the Rosalia Chamber of Commerce has been approved in superior court. The ruling was filed Wednesday, Jan. 4, after a Dec. 16 hearing.
The motion asked the court to reconsider a summary judgment it granted to Josh Bryan, originator of the now defunct 100 Years of Motorcycles rally in Rosalia.
The court initially granted Bryan the summary judgment after ruling the town violated the contract terms for production of the rallies. The court initially ruled the town failed to take any action to resolve the dispute, as required by the contract, before dismissing Bryan from producing subsequent rallies.
The judge also ruled questions of fact remain to be determined at trial. Other parts of the dispute involve ticket sales tabulation and the number of garbage disposal containers provided by Bryan under terms of the rally.
The motion to reconsider cited other court decisions in the state which ruled violations of any terms of a contract voids all of the contract. They contended Bryan and his company, in effect, lacked a valid contract when Rosalia and the Rosalia Chamber subsequently decided to dismiss him after he allegedly failed to meet terms of contract during the 2007 rally.
