Roy Gene Carter, 48, Albion, was sentenced to a year in jail with all but seven days suspended after pleading guilty in superior court Jan. 6 to charges of fourth degree assault and trespassing. Carter was credited with two days time served after he was arrested last Aug. 27. He was ordered to serve the remaining five days in jail.
Carter was arrested after a deputy responded to a report of an intoxicated man who was trespassing on a neighbor’s property in Albion. Carter was described to the court Friday as an alcoholic who had been in recovery for 20 years. He said he was out of control last August when he ran out of medication. The assault charge said Carter grabbed the arm of Wade Winegardner, one of two Pullman officers who responded to the scene to assist. The arrest report said Carter became upset when Winegardner shined a flashlight into the pickup where Carter had been sitting.
Carter will be on probation for one year. He was also ordered to comply with treatment provisions and pay fines and fees of $1,200. Carter was also fined $5,000, suspended pending compliance.
