Jury convicts Pullman resident

A superior court jury Nov. 27 convicted Tyler T. Bagby, 24, Pullman, on all four charges filed against him after Pullman Police responded in the early morning hours last Feb. 4 to a series of calls reporting a break-in and assault at two different locations.

Bagby was convicted of residential burglary, fourth degree assault, malicious mischief and harassment. He has been scheduled for sentencing Dec. 14.

The two-day trial ended Nov. 27 with Bagby testifying in his own defense. He was the only witness for the defense.

The investigation report filed by Pullman Officer Shane Emerson said the department received several calls early Feb. 4 and later determined Bagby was suspected of crimes at two different locations.

The first call sent officers to the Sigma Pi fraternity on NE Oak Street where a male had been knocked out.

Officers learned Bagby had been at a party at the fraternity and was attempting to get a woman with whom he had a relationship to come out of a bathroom where she had allegedly taken refuge. The male who was knocked down was among people at the party who were attempting to get Bagby to desist. Bagby and others involved had left the scene.

At 1:30 a.m. officers responded to a report of a door being smashed in at an apartment on NE California Street. The woman Bagby had attempted to contact at the fraternity had gone to the apartment with another woman who had been in the bathroom with her at the fraternity.

Emerson and Officer Ruben Harris, who responded to the second call; two of the victims, and other witnesses testified for the state.

Two charges, burglary and assault, were originally charged against Bagby after his arrest, and the other two charges were filed before the trial.

Chief Deputy Prosecutor Dan LeBeau represented the state in the two-day trial, and Tracy Collins of Spokane represented Bagby.

Before the trial started, the court issued a ruling on pre-trial motions filed by the state. Judge Gary Libey ruled in favor of the state on the admissibility of statements which were part of the evidence collected by Pullman Police in their investigation.
