Notice is hereby given that Whitman County did, on March 14, 2019, deem complete an application for a Conditional Use Permit (CUP) for the development of a Commercial Agricultural Commodity Warehouse in Whitman County. The proposal includes equipment designed for grain storage on four ground piles, truck scales, a small office space, and utilities on a 66.122 acre site located just south of Dusty, WA, at the intersection of State Highways 127 and 26 in the Agricultural District of unincorporated Whitman County. For a more detailed description of the project proposal, see the project application materials which are available for public review at the Whitman County Planning Department at 310 N. Main Street 2nd Floor, Colfax, WA. Office hours are Monday through Friday 8.00 a.m. to 5.00 p.m.
Applicant: McCoy Land Company, LLC. The CUP application was submitted on February 21, 2019.
Location: 26791 SR 127, just south of Dusty, WA, and the intersection of SR 127 and SR 26 in Section 9, Township 15N, Range 41 E.,W.M., Whitman County, WA.
State Environmental Policy Act (SEPA): A Mitigated Determination of Nonsignificance (M-DNS) was issued for this project on August 16, 2018, in association for a zone change application for the property. The SEPA comment period ended on August 30, 2018. Three comments were received within the comment period. The Responsible Official for the SEPA decision responded to the comments and upheld the original M-DNS decision. The zone change request was eventually withdrawn on January 13, 2019.
Timing: The hearing for the conditional use has yet to be scheduled. The applicant has chosen to have a hearing examiner conduct the hearing instead of the Whitman County Board of Adjustment. This is allowable under Whitman County Code 19.06.055. The stated estimated value of the project is in excess of five million dollars.

The purpose of the hearing is to receive public comment for proposed revisions to the Whitman County Zoning Code, Title 19.10 as it relates to Agricultural, to clarify language for the creation of residential parcels and the issuance of Rural Housing Certificates (RHC); clarify the boundary line adjustment process in relation to residential parcels less than 20 acres; modify the Rural Residential Site Review (RRSR) process; change the commercial agricultural operator’s appeal time of an RHC from 20 days to 10 business days ,; and amend the language for the design and construction of residential driveways to reflect a change in the Fire Code; and Title 19.12 as it relates to Cluster Residential District, amending the language for the design and construction of residential driveways to reflect a change in the Fire Code in order to make it consistent with the same change in Chapter 19.10, as described in the proposed ordinance hereto attached and made a part of by reference.

NOTICE OF PUBLIC HEARING
The Whitman County Commissioners will conduct a public hearing will be held by the Whitman County Board of Commissioners in their Chambers, Whitman County Courthouse, Colfax, Washington on Monday, April 1, 2019 at 10:30 a.m.
The purpose of the hearing is to review community development and housing needs, inform citizens of the availability of funds and eligible uses of the state Community Development Block Grant (CDBG), and receive comments on proposed activities, particularly from lower income persons residing in the Whitman County area.
$99,106 is proposed to be available annually to Whitman County and the Community Action Center to fund public services that principally benefit low-and moderate income persons in Whitman County.
An overview of the proposed public services will be available for review at the Whitman County Commissioners' Office (400 N Main Street, Colfax, WA 99111) and Community Action Center (350 SE Fairmont Road, Pullman, WA 99163) on Monday, March 25, 2019 beginning at 9:00 a.m. Comments may also be submitted in writing to Whitman County Commissioners at 400 N Main Street, Colfax, WA 99111 until April 1, 2019 at 10:30 a.m.
Comments on the County's and Community Action Center program's past performance and use of their 2018 CDBG Public Services grant will also be received.

The City of Tekoa council adopted Ordinance No. 850 at their March 18, 2019, council meeting. The ordinance transfers the MVET from the current expense fund to the street fund and the city-county assistance revenue from the street fund to the current expense fund. Request for Proposal for Fiber-to-the-Home Design Work
The Port of Whitman County is seeking proposals for fiber design work from interested parties for its proposed Fiber-to-the-Home (FTTH) Network in five rural Whitman County communities: Rosalia, Oakesdale, Tekoa, Garfield, and Palouse.

The City of Palouse has applied for a National Pollutant Discharge Elimination System (NPDES) permit modification in accordance with the provisions of Chapter 90.48 Revised Code of Washington (RCW), Chapter 173-220 Washington Administrative Code (WAC), and the Federal Clean Water Act.
The City of Palouse sent an email to Ecology on March 8, 2019 requesting an NPDES permit modification. The City requested a deadline extension for submittal of a required facility plan.
Ecology is issuing a draft amended permit and fact sheet amendment and is only accepting comments on the modified portions.
The wastewater, following treatment, must meet the requirements of the Washington State Water Pollution Control Act and applicable regulations for a permit to be issued. A tentative determination has been made on the effluent limitations and special permit conditions that will prevent and control pollution. A final determination will not be made until all timely comments received in response to this notice have been evaluated.
