Hughes files motion for Pre-Trial release

COLFAX - A Pullman woman filed a motion for pre-trial release amid drug charges in Whitman County Superior Court.

Diana Hughes, 39, filed a motion to revoke her pre-trial release in Whitman County Superior Court on Friday, Sept. 27, amid charges of possession of a controlled substance with intent to deliver.

According to the court documents, Hughes was involved in a drug investigation that began when law enforcement used a Facebook profile to communicate with a suspect, Antonio Tenzsley, who had an active warrant for assault.

The investigation revealed a series of messages between Tenzsley and Hughes, during which they arranged to sell methamphetamine.

According to court documents, on June 8, police observed Tenzsley and Hughes meeting in Pullman.

After stopping Tenzsley's vehicle, law enforcement officers discovered approximately half a gram of methamphetamine on him and a more substantial amount in Hughes's possession.

She allegedly had 13 grams of meth divided into three bags, along with paraphernalia indicating intent to distribute.

Hughes, who has a medical condition preventing her from being incarcerated at the time of arrest, was released on the scene.

Charges of possession with intent to deliver methamphetamine have been forwarded to the prosecutor's office.

The motion to revoke her pre-trial release will be considered by the court as the case proceeds.

A significant portion of the hearing addressed Hughes' inability to submit a DNA sample for testing.

Her defense cited her failure to provide sufficient saliva for the test and her inability to appear at scheduled appointments due to transportation issues.

Hughes, who is paraplegic and confined to a mobility chair, cannot complete urinalysis tests.

Hughes argued in court, stating, "I don't have a problem giving all of my saliva."

However, the prosecution argued that transportation should not be an issue, pointing out that Hughes was arrested in a vehicle while allegedly attempting to deliver methamphetamine.

Superior Court Judge Doug Robinson ordered for another saliva test to take place after a lunch recess.
