COLFAX — Whitman County District Court reported the following criminal conviction sentences from Oct. 11:

Bryan Boutwell-Samuelson, was found guilty of domestic violence, intimate partner, therefore the defendant is sentenced to serve a total of 13 days in jail with credit for 13 days served. The defendant has a domestic violence fee of $15 due by Dec. 31, 2024, and has supervised probation for 24 months. The defendant must have no criminal violations of law and must not go upon the property of and have no contact with the victim, complying with all active no contact orders. Probation shall transition to unsupervised probation at the discretion of probation only after Defendant has verified terms and conditions of probation in Idaho, engagement and compliance with that jurisdiction’s probation. The defendant has been notified of ineligibility to possess a firearm, for the crime committed on or after July 23, 2023 for domestic violence. The defendant is ordered to immediately surrender all firearms and any concealed pistol license(s). The defendant may not possess, own or have under control a firearm and under federal law any firearm or ammunition or a concealed pistol license until rights have been restored. Violation of these laws is a felony. The defendant came before the court to enter a plea admitting violation probation, therefore no sanctions were imposed. The defendant shall remain on supervised probation. Probation may transition to unsupervised probation at the discretion of probation after Defendant has verified terms and conditions of probation in Idaho, his engagement and compliance with probation in that jurisdiction.

Jason Day, was found guilty of failure to obey a law enforcement officer, therefore is sentenced to 90 days of jail, none suspended. The defendant must have no criminal violations of law and has supervised probation for 24 months and must obtain an alcohol/drug evaluation, and a mental health evaluation from a licensed mental health provider with a filed copy within 20 days. The defendant must not use or possess alcohol or marijuana and provide urinary assessment randomly. Probation shall meet with the defendant as soon as possible to develop a plan for release that assures the court the defendant does not pose a danger to himself or others. Earlier release may be granted up to the presentation of a plan. A review hearing shall be scheduled for 9 a.m., Nov. 20 to monitor progress. Defendant shall contact probation no less than one time each.

Javani Barrios-Peralta, through Lindsi Alcantar Whitman County Deputy prosecuting Attorney pursuant to plea agreement amends the charges of violation of protection order to disorderly conduct, using abusive language and thereby intentionally creating a risk of assault. Therefore, the defendant is sentenced to 90 days of jail, 89 suspended and must serve one day in jail with credit for one day served. The defendant must have no criminal violations of law, and supervised probation for 12 months. Defendant shall complete ADIS as has been recommended within 90 days and transition to unsupervised probation for Mar. 15, 2025 if he has completed all affirmative obligations and no violations of probation have been committed. The defendant came before the court, admitting violation of probation, the court found the defendant in compliance with domestic violence counseling and the defendant has completed an alcohol evaluation. No sanctions are imposed.

Tad Peringer, by and through Lindsi Alcantar Whitman County Prosecuting Attorney and pursuant to a plea agreement amends the charges of hit and run attended vehicle to hit and run unattended vehicle for operating a vehicle that collided with another vehicle unattended and failed to stop and either locate. The defendant did not locate and notify the owner or leave in a conspicuous place a written notice. Therefore the defendant is sentenced to 90 days of jail, 89 suspended and must serve one day in jail with credit for none. One day in jail may be converted to 18 hours community service within 90 days. The defendant must have no criminal violations of law and supervised probation for 12 months. Defendant shall be transferred to unsupervised probation after he has completed jail or community service.
